Archive Witness beta terms

These terms are an agreement between you and Teal Horse, LLC for your use of Archive Witness. They are written for the pre-production beta and should be reviewed again before a paid production release.
1. What the beta is
Archive Witness is pre-release software for cataloging and reviewing evidence about archived files. Beta software may contain defects, incomplete features, or behavior that changes before production.
Do not make Archive Witness your only protection against data loss. Keep independent backups and preserve important external recovery or checksum evidence.
2. Permission to use it
While your beta entitlement is active, you may install and use the beta for your own personal, household, professional, or internal evaluation. The beta license is non-exclusive, non-transferable except through supported licensing mechanisms, and subject to any technical device/lease limits shown by the software.
You may share an unmodified beta installer when the release page allows public beta distribution. Sharing the installer does not create a permanent license or let anyone bypass licensing, signing, or integrity controls.
You may not use Archive Witness to violate law, defeat its licensing or security controls, or represent yourself as the publisher of the software.
3. Your files and decisions remain your responsibility
Archive Witness can calculate checksums, test media, compare evidence, record approvals, and perform explicit controlled writes such as Restore. Those tools help you make and document decisions; they do not guarantee that a file is historically authentic, legally admissible, recoverable, or safe to delete elsewhere.
Review confirmations before accepting new evidence or authorizing writes. You are responsible for maintaining appropriate backups and for deciding which evidence or file version you trust.
4. Updates and beta changes
The beta may require renewal of a short-lived beta entitlement and may stop being issued when the beta program ends. Features, file formats, services, distribution channels, and these beta terms may change before production.
Archive Witness is designed to keep durable user data separate from replaceable application files, but you should still back up important catalog data and exported manifests before installing test builds or updates.
5. Third-party software
Archive Witness includes or works with third-party software, including FFmpeg components for media testing. Third-party components remain subject to their own licenses. See Third-party notices and source provenance.
6. No warranties
To the maximum extent permitted by law, the beta is provided as is and as available, without warranties of uninterrupted operation, fitness for a particular purpose, data recovery, preservation, authenticity, or legal admissibility.
Some jurisdictions do not allow certain warranty exclusions, so those exclusions apply only to the extent legally permitted.
7. Limitation of liability
To the maximum extent permitted by law, Teal Horse, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost profits, or business interruption arising from use of the beta.
For any claim that cannot legally be excluded, total direct liability relating to the beta is limited to the greater of the amount you paid for Archive Witness during the 12 months before the claim or US $50, unless applicable law requires a different result.
8. Ending use
You may stop using the beta at any time. Beta entitlement may expire or be disabled according to the beta program. Expired or unlicensed software is intended to preserve safe access to existing catalog/history, licensing/help, and approved evidence backup/export while disabling normal Archive Witness work.

Archive Witness is published by Teal Horse, LLC, a Texas limited liability company.
